Conditions of Use

Welcome to Home Adonait. These Conditions of Use govern your access to and use of the Home Adonait marketplace, including any content, functionality, and services offered on or through home.adonait.com (the “Site”), whether as a guest, a buyer, or a vendor. By accessing or using the Site you agree to be bound by these Conditions of Use and all policies referenced here.

1. The marketplace and our role

Home Adonait is an online marketplace that connects independent third-party vendors (“Vendors”) with buyers. Adonait is not the seller, manufacturer, distributor, or importer of any product listed on the Site, does not take title to any product, and does not warehouse, inspect, pack, or ship products. Each Vendor is the seller and merchant of record for the products it lists and is solely responsible for those products and the fulfillment of orders.

2. Eligibility and your account

You must be at least 18 years old and able to form a legally binding contract to use the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Orders and payment

When you place an order you are making an offer to purchase from the relevant Vendor. Payment is processed by our payment provider (Stripe). Prices, availability, and product information are provided by Vendors and may change without notice. Adonait facilitates the transaction and remits the proceeds to the Vendor, less a marketplace commission.

4. Shipping, returns, and refunds

Shipping, delivery, returns, and refunds are governed by each Vendor’s policy and by our published Shipping and Refund policies. Adonait may help coordinate a resolution but does not guarantee any outcome, refund, replacement, or return.

5. Prohibited conduct

You agree not to misuse the Site, including by: violating any law; infringing intellectual property; posting false, misleading, or harmful content; attempting to interfere with the Site’s operation or security; scraping or harvesting data without permission; or using the Site to sell counterfeit, unsafe, recalled, or prohibited items.

6. Intellectual property

The Site and its original content, features, and functionality are owned by Adonait and are protected by intellectual-property laws. Product names, brands, trademarks, and images belong to their respective owners and their appearance does not imply any affiliation with or endorsement by Adonait.

7. Disclaimers and limitation of liability

The Site and all products are provided “as is” and “as available.” To the fullest extent permitted by law, Adonait disclaims all warranties, express or implied, and shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any product, order, defect, injury, loss, or dispute. Adonait’s total liability for any claim shall not exceed the marketplace commission actually received on the relevant order. You use the marketplace and purchase from Vendors at your own risk.

8. Indemnification

You agree to indemnify and hold harmless Adonait and its owners, affiliates, and agents from any claim or demand arising out of your use of the Site, your violation of these Conditions, or your violation of any rights of a third party.

9. Governing law and disputes

These Conditions are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Miami-Dade or Broward County, Florida.

10. Changes

We may update these Conditions of Use at any time. Continued use of the Site after changes are posted constitutes acceptance. See also our Privacy Notice, Policies, and Contact pages.
